Aaj is post mein aap sbhi ko Industrial Dispute Act, 1947 ke bare mein batane ja rha hu.
Strike hoti kya hai? Strike kab illegal ho jaati hai ? Strike jab illegal tarike se hoti hai, to iski sja kya hai?
Industrial strike kya hai aur kab strike illegal hoti hai aur kya hai sja ka pravdhan. ( What is Industrial Strike and when its became illegal and penalty for illegal strike and lockout)

Isse pahle hum ek choti se baat samjh le ki Industry kya hoti hai?
Industry ko hum aap sabhi log simple language mein smjh sakte hai, ek aisi jagah jaha kai vyaktiyo dwara production aur manufacturing ka kaam kiya jata hai. Har industry mein ek malik (owner) hota hai jo waha ke karmchari ko adesh deta hai kaise kaam kaam karna hai uske liye ek supervisor bhi appoint kiya jata hai jo ki in karmchariyo ( labour) ko kaam karne ka sahi aur surakshit tarike se machine mein kaam kaise kare yah tarika bhi batata hai.

Har ek Industry mein ek Union Leader hota hai, jo us industry mein kaam kar rhe karmchari (labour) ki awaj apne industry owner tak pahuchata hai. Yadi kisi bhi parakr ki koi bhi dikkat labour ko hoti hai, to aise mein har karmchari apne Union leader se kahte hai.

Kya hai Strike?
Industrial Act ,1947 ke section 2(q) ke anusar strike use kahte hai, jab kisi industry mein wahan ke kaam karne wale vyaktiyo ke union dwara ek hokar kaam ko band kar dena ya industry ke kaam ko karne se inkaar kar dena  ya kaam ko karne se aswikaar kar dena. Strike labour aur group of labour's dwara kaam ko karne se mna kar dena ya kaam ko karne se rok dena.

Stirk ek manyta prapt weapon hai labour's ka jiske istemal se labour industry ke owner dwara kiye gye bad behavior  ke khilaf ya apni mango ( demand) ko pura karne ke liye kiya jata hai.


Srike hoti kitny prakar ki hai? ( Type of Strike)
  1. Legal.
  2. Illegal.
1.legal strike; Legal strike ko hum kah sakte hai us strike ko jab kisi industry ke union leader dwara pahle se Notice di jaati hai ki vah Strike karne ja rha hai. Strike karne se 30 din pahle vah Employer ko notice deta hai, jiska matlab yah ki us union leader ne apne employer ko strike karne ki information pahle se de di hai. legal strike legal demand ko lekar hi ki jaati hai.Isme labour ko wages diya jata hai.

2.Illegal Strike; Illegal strike vah strike hai jab kisi hi industry ke karmchri (labour) ya union of labour ke dwara bina kisi notice ke diye hi strike kar dena. Illegal strike mein unki demand bhi illegal hi hoti hai.

3.General strike; General strike vah strike hoti hai jisme labour kisi general demand ko lekar baat karte hai aur kam se alag rahte hai aur kaam par ate hi nahi hai.

4.Vilamb karo ya Hatiyar dalo strike. Is prakar ki strike mein labour kaam par to ate hai, par industry ka koi kaam nahi karte hai.

5.Dheere kaam karo strike. Is prakar ki strike mein labour kam par to ate hai, kaam karte bhi hai par kaam karne ki gati dhere hi rahti hai.

Strike ke kya karn hai. (Reason of strike)
  1. Employer dwara karmchariyo ya unke union ki demand ko pura na karna yaha demand se matlab hai, Wages, Bonus etc.
  2. Other striker ki shanubhooti (sympahty) .
  3. Niyokta (employer) ke galat achran ke karn  se bhi srtike hoti hai.
  4. Samajik dasha ka kharab hona.
  5. Kaam mein nirasha hone par.
Strike aur lockout kab illegal mana jata hai. (When does strike aur lockout is illegal.)

1. Industruial Act, 1947 ke Section 22 mein kuch condition batai gyi hai yadi in condition 's ka ullanghan hota hai , to Strike ilegal mani jayegi.

  1. Jab strike karne se 6 weeks pahle notice nahi di jati hai.
  2. Strike karne se pahle jo notice di jati hai, us notice ko dene ke 14 dino ke bhitar hi strike karna.
  3. Notice mein likhi srtike karne ki date se pahle hi strike kar dena.
  4. Attribute tribunal ke samne pending karya vahi ke time ya to fir karya vahi ki khtm hone ke 7 dino ke under hi strike karna.
  5. Labour court ,Tribunal ya National Tribunal ke samne nirdeshit vivad ki pending karya vahi ki awadhi mein aur decision diye jane se 2 mahine pure hone se pahle hi kaam band kar dena.
  6. Ek di nse jada ki prateek strike illegal hogi niyam ke anusar strike 1 din se jada nahi honi chahiye.
  7. Strike karne se pahle yadi notice nahi di jati hai, to strike ilegal hogi.
2. Industrial Act, 1947 ke Section 23 mein bhi kuch condition ko bataya gay hai, yadi inka ullanghan kiya jata hai to aise mein vah strike illegal hogi.
  1. Yadi koi industrial dispute labour court , Tribunal ya National Tribunal ke samne pending hai aur us time yadi strike hoti hai to illegal strike hogi.
  2. Inke decisiondiye jane ke 2 mahine tak bhi lockout varjit hai.
Illegal strike karne par sja kya hai ? ( Penalties for an illegal strike or lockout)
  1. Industrial Act, 1947 ke section 26(1) ke antargat yadi koi bhi industry ka labour ya union labour illegal strike shuru karta hai, to aise mein usko jail ki sja jok ki 1 month ki hogi ya jurmana bhi dena hoga jo ki 50 rupya tak ka hoga ya in dono prakar ki sja bhi ho sakti hai.
  2. Section 26 (2) ke anusar yadi koi niyojak (Employer) illegal lockout karta hai, matlab industry ko illegally band karta hai , to  aise mein 1 month ki jail ki sja ya 1000 rupya jurmana ya fir dono se.
