Aaj is post mein aap sabhi ko "The Hindu Marriage Act, 1955 ke section 13(B) ke bare mein batane ja raha hu, Section 13 (B) mein Divorce ke bare mein bataya gya hai, Is Section 13(B) mein divorce ke different ground bataye gaye hai, aaj hum baat karnege Section 13(B) ke divorce ke ground Mutual consent ke bare mein. Yadi Pati aur Patni kisi kaarno se apsi sahmati se Divorce lena chahte hai, to Ve dono apsi Sahmati se ( Mutual Consent) divorce kaise le sakte hai.

Apasi Sahmati se talaq ke liye 6 mahine ka intzar jaruri nahi.( With mutual consent, waiting for 6 month for divorce is not necessary.)

Divorce lene ki prakriya mein 6 mahine ka intzar karne ki bat kahi gyi hai. Yah 6 mahine ka time Judge final decree dene ke liye leta hai. Supreme Court ne kaha ki divorce ke antim adesh ke liye 6 mahine ka time lena Civil Judge ke vivek par nirbhar hoga, Yadi Judge chahe to khas paristhitiyo ( condition) mein Civil judge divorce ke liye turant adesh de sakta hai.

Talaq ke liye antim faishle par 6 mahine ka intzar kyo kiya jata hai?
Section 13 B mein kaha gya hai ki talaq ki arji jab family court mein di jaati hai, to talaq ke liye antim adesh 6 mahine baad isliye diya jaat hai, taki yadi Pati aur Patni mein apasi sulah- nama ho jata hai, ya ve dono apne talaq ke is faishle ko badal de.

Talaq ke liye First motion ya pahli arji family court mein dayar karne ke 6 mahine baad second motion ho sakta hai.

Kis Case ke aadhar par Talaq ke liye 6 mahine ke is time ko khtm kiya gya.
Delhi ki tees hajari court mein Pati aur Patni dwara apasi sahmati se talaq ke liye ek arji dayar ki gyi, Is arji ke mutabik Pati aur Patni dono lagbhag 8 saal se alag rah rahe thy. Apasi sahmati se liye jaa rahe talaq mein in dono ne kai cheejo ke bare mein apasi sahmati kar li thi, jaise :

  1. Baccho ki custody ke bare men,
  2. Maintenance  ke bare mein,
  3. Aur bhi kai bato ke bare mein in dono ke beech apasi sahmati ho gyi thi.
In sabhi sahamti ke baad bhi judge ne in dono ko 6 mahine ka time intzar karne ke liye diya. jo ki is adhiniyam ke antargat ata hai.

Supreme Court ne is 6 mahine ke talaq ke liye intzar ko khtm kar diya, sath hi desh ki kai Family Court ko yah adesh (order) bhi diya ki ab se ve "Hindu Marriage Act, 1955 ke section 13B jo ki 6 mahine ka time talaq ke liye pravdhan kati hai, usko jaruri na mane.
Yadi judge ko yah uchit lagta hai, ki wah talaq ka adesh turant se sakta hai.

Kin conditions mein talaq ka adesh turant diya ja sakta hai.
  1. The Hindu Marriage Act, 1955 ke section 13B(2) mein talaq ke antim faishle ke liye Pati aur patni dono ko  6 mahine ka time diya jata, Aur Section Section 13B(1) mein  1 saal shadi ke pure ho jane ke bare mein kahta hai, Yadi yah time pahle se beet chuka ho, Matlab jab Pati aur Patni ne mutaul divorce ke liye jab petiton family court mein file ki thi tab se in dono ko alag huye 1 saal 6 mahine ho rahe ho. 
  2. Yadi Pati aur Patni mein sulah-nama ke sare vikalp asfhal ho chuke ho, matlab ab Pati aur Patni mein agey bhi kisi bhi prakar ki koi bhi sulah-name ki ko gunjaish na ho,
  3. Yadi Pati aur Patni ke beech  gujare ke liye permanent settlement ho gya ho.
  4. Yadi Pati aur Patni ke beech baccho ki custody ko lekar settlement ho gya ho.
  5. Yadi Pati aur Patni ke beech talaq ke is 6 mahine ka intzar aur pareshani (problem) ka kaarn banta ho.
Divorce ki petition file karne  ke 1 hafte (weeks) baad Pati aur Patni in sabhi condition ka reference dete huye, turant Talaq (Divorce) ki mang kar sakte hai. Yadi in dono ki is turant talaq ki mang ko Family Court ke judge ko uchit lagta hai, to wah Divorce ka adesh (order) turant de sakta hai.
