Aaj is post mein aap sabhi ko womens ki protection ke liye banaye gaye kanoon ke bare mein baat karunga, jo ki 2013 mien lagu kiya gya. Haa hum baat karne ja rahe hai "The Sexual Harassment of Womens at Workplace Prevention, Prohibition and Redressal Act, 2013 kya hai ?

Kya hai "The Sexual Harassment of Women at Workplace Prevention, Prohibition and Redressal  Act ,2013 ?
 " The Sexual Harassment Of Women at Workpalce Prevention, Prohibition and Redressal Act , 2013 is adhiniyam ko banane ka mian maksad yah hai ki un mahilao ko Sexual Harassment se protection dilaya ja sake jo kisi Company, Firm ya Factory mein kaam kar rahi hai. Aisi jagaho mein hone wale sexual harassment se in mahilao ko suraksha pradaan ki jaye, taki koi bhi mahila karmchari apne workplace mein sexual harassment ka shikar na ho sake,
  1. 3 December 2012 ko loksabha mein yah bill parit kiya gya tha.
  2. Is bill ko 26 February, 2013 ko Rajya sabha dwara parit kiya gya tha.
  3. 23 april 2013 ko is bill ko President ki swikriti mil gayi thi
  4. Aur President ki swikriti milne ke baad is bill ko India mein 9 December 2013 ko lagu kar diya gya.
  5. Is kanoon ne India ke supreme court dwarapesh kiye gaye yaun utpeedan o rokne ke liye "Vishaka Guideline" jari ki gyi.
  6. 10 se adhik karmcahri wali kisi bhi karya stahal mein is adhiniyam ko lagu karne ki jarurrat hai.
 IS adhiniyam ka uddeshsya kya hai ? (Objective of this Act.)
  1. Workplace jaise Company, Firm, YA Factory mein kaam kar rahi mahila karmcahri ke sath hone wale sexual harassment ko rokne ke liye aur sexual harassment ki complaint ke solution ke liye aur issay sambandhit mahilao ko suraksha pradan ki jaye,
  2. Constitution ke Article 14 mein samanta ka adhikar har nagriko ko moolbhoot adhikaro ke roop mein pradaan kiya gya hai, wahi sexual harassment is fundamental right ka ullaghan karta hai. Constitution ke Article 21 mein JIvan jine ke adhikar ke bare mein kaha gya hai ki har nagrik ko apni garima ke sath jine ka adhikar hai.IS adhiniyam mein yah kaha gya hai ki Mahilao ko yah adhikar hai, ki wah jaha kaam kar rahi hai waha ka environment sexual harassment free hona chahiye.
  3. Is adhiniyam mein mahilao karmcahriyo ke sath hone wale sexual harassment ke khilaf baat kahi gyi aur sath hi sath mahilao ke protection ki baat khai gyi hai.
Kya Yah Adhiniyam kewal kaam karne wali mahilao ke liye hai ?
Nahi,
Yah adhiniyam un har mahilao ke liye hai, jo kisi bhi karya-sthal mein kaam akrti hai, aur waha un mahilao ke sath sexual harassment jiasa apradh kiya gya hai. Jis Company, Firm ya Factory mein mahila karmchari kaam kar rahi hai yah jaruri nahi hai ki usay pareshan hi kiya jata hai. Krya sthal koi bhi ho sakta hai, chahe wah Government ho ya Private.

Yadi mere office mein sexual harasment jaisa koi mamla hai, to fir bhi kya mein Internal Complaint committee establish karu ?
Haa, 
Yadi aapke office mein abhi tak koi sexual harassment ka mamla nahi hai, to bhi aapko ek Internal Complaint Committee establish karne ki jarurat hai. Yadi aap apni company mein 10 se jada logo ko rojgaar dete hai, to  aapke dwara is adhiniyam ke sabhi niyamo ka palan kiya jana bahut jaruri hai.

Kya is adhiniyam ke anusar muje Police ya court mein shikayat darj karva sakta / sakti hu ?
NO, 
Is adhiniyam ke dwara aapko apradhi ke sath working place mein hi niptane ya court mein aane ka ek vikalp deta hai. 
Yadi aap chahe, to apni internal ya local complaint committee ke pass jane ke bajaye aap criminal complaint file kar sakte hai.
