Aaj is post mein aap sabhi ko Indian Partnership Act, 1932 ke bare mein batane ja rha hu, ki Kisi bhi Firm ya Company se koi bhi ek partner kab aur kyo alag ho jata hai, matlab yah ki vah Firm ya company se kyo nikal jata hai.

Jab koi bhi Partnership Firm ya Company shuru hoti hai ,to aise mein us Firm ya Company mein kuch partner's bhi hote hai, jaise 4 ya 8 maan lete hai. Jab ye partner's aate hai ,to kcuh capital bhi lekar kar aate hai taki firm ya company ka kaam bhi ho sake jis kaam ke liye ve aapas mein milkar isko banate hai. Har partner ki apni apasi sahmati hoti hai business ke kaam ko lekar.
Har partner's mein partnership deed bhi hoti. Par kuch aisa time aa jata hai jab in partner mein se koi ek partner ko alag hona pdta hai, aaj is post mein inhi kaarano ki baat baat karenge.

Nirgaami bhagedar kaun kahe jate hai ? ( Who is called as an Outgoing Partner ?)
Outgoing Partner ve partner kahe jaate hai, jo kisi Firm ya Company se alag ho jate hai jiska matlab yah hai ki ve firm ya company se nikal jate hai. In Out going partner ke nikal jane se firn ya Company mien bache (left) hue partner ke dwara business ka kaam chalu rahta hai. To jab koi partner kisi firm ya company se alag ho jaata hai , to us partner ko outgoing partner kaha jata hai.
  1. Jab koi bhi partner firm ya company se alag hota hai ,to aise mein us partenr ke sare sambandh (relation) vaha se samapt ho jate hai.
  2. Baaki bache (left) hue partner ke sare sambandh (relation) vaise hi bane rahte hai jab ki ve firm ya Company mein bane rahte hai.

Kisi bhi Firm ya Company se koi bhi partner kab kyo aur kaise alag ho sakta hai uske bare mein Indian Partnership Act, 1932 mein bataya gya hai. Ve kaun se tarike hai, jab ek partner firm ay company se alag ho sakta hai.
Chaliye to baat hai un tariko ke bare mein jab ek partner firm ya company se alag ho sakta hai. 
  1. Section 32 Retirement of partner.
  2. Section 33 Expulsion of partner.
  3. Section 34 Insolvency of partner.
  4. Section 35 Death of partner.
Chaliye ab hum jante hai in sabhi dharoa (section) ko ek -ek kar ke inke bare mein.

1.Section 32 Retirement of Partner - JAb kisi bhi firm ya company ka partner firm ya company se istifa dekar kar firm ya company se retirement leta hai ,to aise mien vah partner firm ya company se alag ho jaata hai, aur baaki bache (left) huye partner ke dwara firm aur company ka business chalu rhat hai.
Koi bhi partner firm ya compnay se in tariko se retire ya istifa se sakta hai.
  1. Firm ya  Company ke sabhi bhagidaro (All partner's) ki sahmati (consent) se alag ho sakte hai.
  2. Partnership deed mein yadi iska ullekh kiya gya hai to,
  3. Yadi kisi partner ki yah iccha (will) hai, ki vah firm ya company se alag hona chahta hai, to aise mein us partner ko firm ya company ke bache (left) huye sabhi bhagidaro ko likhit mein apne retirement ki notice dega. Is notice mein sabhi partner ki shamati ho,
  4. Yadi Notice mein retirement ki date nahi likhi hoti hai, to aise mein jab notice di jaati hai hai, usi date ko retirement ki date mani jayegi.
2.Section 33 Expulsion of Partner-  Ek Partner kisi bhi firm ya company se tab nikala ja sakti hai, jab vah partnership deed ya agreement ka ullanghan karta hai,  Partner ke beech huye agreement ke dwara di gyi gyi power ka itstemaal kar ke koi bhi partner kisi bhi ek partner ko bina kisi vjah se hta nahi sakta, Vah partner firm ya company se tabhi nikala ja sakta hai yadi uska nikala jana company ya firm ke bahut jaruri hai. Section 32 ke sub section (2), (3), aur (4) ke upbandh usi prakaar lagu hote hai jaise, ki retirement partner ho. 

Section 33 mein kuch aise hi condition ki baat ki gyi hai, jab kisi partner ko firm ya company se nikala ja sakta hai.
  1.  Yadi sabhi partner ke beech agreement hua ho, to aise mein partner ko nikalne ke liye partner ko authorize karta ho.
  2. Aisi power ya right ka istemal jab acche kaam se kiya jaata hai, ki firm ya company ke hit ( interest) mein. ya to company ya firm ke protection ke liye us partner ko nikala gya ho.
3. Section 34 Insolvency of partner -  Yadi kisi bhi firm ya company ka ek partner diwaliya ho jata hai ,to aise mein wah firm ya company se alag ho jaat hai, aise mein firm ka dissolution nahi hota hai. Firm ya Company ke bache (left) baaki sabhi partner's ke dwara business ka kaam chalu rahta hai.
  1.  Yadi firm ya company ka koi bhi ek partner diwaliya ho jaat hai, to aise mein us partner ke sare sambandh us firm ya company se samapt ho jate hai.
  2.  Diwaliya ho jana ek bahut badi ghatna (incident) hoti hai isiliye jab koi partner diwaliya hota hai, to aise mien partner ko diwaliya hone ki public notice nahi deni hoti hai.
  3. Jab koi partner diwaliya ho jata hai, tab us date se hi us partner ka us firm ya company se koi sambandh samapt ho jata hai.
4. Section 35 Death of partner-  JAb kisi firm ya Company ke kisi ek partner ki mrityu (death) ho jaati hai, aur partnership deed mein likhe upbandh ke kaaran se firm dissolve nahi hoti hai to, aise mein us mritak partner ko firm ya company se alag maan liya jata hai.
  1.  Mrityu ka hona ek bahut badi ghatna hoti hai, aise mein public notice ki bhi jarurat nahi hoti hai.
  2. Mrityu ki date se mritak partner ki property firm ke karyo (act) ke liye dayi (liable) nahi hoti hai.
