Aj mein apne is post mein aap sabhi ko batane ja raha hu Bahrtiya Dand Sanhita ki dhara 302 ke bare mein. Aap sabhi log aksar yah sunte aur padhte hai ki Hatya (Murder) ke mamle mein adalat (Court) ne Bahrtiya Dand Sanhita ki dhara 302 ke tahat  mujrim ko hatya ka doshi paye jane par mujrim ko sja e mout ( death to sentence) ya fir umr kaid ( life Imprisonment) ki sja di jati hai.  lekin Abhi tak kai log dhara 302 ke bare mein nahi jante honge.

Kya hai Bhartiya Dand Sanhita ki dhara 302? (What is Section 302 of The Indian Penal Code 1860.)

Bhartiya dand Sanhita ( Indian Penal Code), ke anusar yadi India mein koi vyakti kisi bhi prakar  apradh karta hai to usay isi adhiniyam mein batye gaye pravdhan ke anusar hi sja dene ka pravdhan  hai.Lekin yah adhiniyam Jammu & Kashmir mein lagu nahi hota, vaha par is adhiniyam ke sthan par Ranbir Penal Code lagu hoti hai.

Indian Penal Code british logo dwara hi banayi gyi thi aur time to time isme kafi sansodhan (Amendment) hotey rahe.

Indian Penal Code ki dhara 302 ( Section 302 )  Hatya ke aropi pr lagai jati hai.
Agar koi bhi vyakti kisi vyakti ki hatya karta hai aur uska yah jurm kanoon ki najro mein sabit (proof) ho jata hai, yah hatya usi vyakti dwara ki gayi hai to aise mein us vyakti par dhara 302 ke anusar use sja di jayegi, jo ki Umr kiad ( liffe imprisonment) ya fasi ( hang) ki sja aur sath mein hi jurmana bhi dena ho sakta hai.

Hatya ke mamle mein khas kar hatya ke irade (intention) aur uske maksad apr dhyan diya jata hai, Is tarah ke mamlo mein police ko evidence ke sath yah bhi sabit (proof) karna hota hai ki hatya aropi ke dwara hi ki gayi hai, aur uske pass is hatya ka maksad bhi tha aur vah hatya karne ka uska irada bhi tha.

Kai hatya ke mamlo mein nahi lagti Dhara 302 to fir kon si dhara lagti hai ? 
Hatya ke mamle mein dhara 302 ka istemal nahi kiya jata, Ve aiase hatya ke aise male hote hai jisme kisi vyakti ki hatya to hoti hai par usme ksis ka iradtan dosh nahi hota, tab aise mamlo mein Indian Penal Code ki Dhara 304 us par lagai jati hai. Jismein  manav vadh ke mamle mein sja ka pravdhan hai.

Bhartya Dand Sanhita ki Dhara 299 mein Manav vadh ke bare mein btati hai. ( Section 299 Culpable Homicide ).
Agar koi vyakti kisi vyakti ko marne ke irade se ya kisi ke sharir ( body) par aisi jakhm pahuchane ke irade se hamla karta hai jisme us vyakti ki hatya sambhav ho, ya janbhoojkar kar koi aisa kam  kare jiski vajah se kisi ki hatya sambhav hho, to aise mamlo mein us karya ko karne wala vyakti apradh karta hai, Is adhinyam ke nausar jise mana vadh kaha gya hai.

Dhara 299 Manav vadh mein kuch Spatikaran hai . ( Some Clarification of Section 299, Culpable Homicide)

  1.  Koi vyakti kisi vikar rog se grasit ya anya kisi rog se grasit dusre vyakti ko sharirik chati          (physical harm) pahuchata hia aur issay us vyakti hatya ho jati  hai, to yah samjha jayega ki pahle vyakti ne dusre vyakti ki hatya ki hai.
  2. Jis mamle sharirik chati ( physical harm) ki vajah se kisi vyakti ki hatya ho jati hai, Aur agar mare gaye vyakti ko yadi sahi time par medical treatment mil gayi hoti to use bachaya ja sakta tha, To bhi yahi samjha jayega ki us vyakti ki hatya ki gayi hai.


Hatya ke mamle mein Dhara 302 ko sabse adhik gambhir aur majboot mana jata hai jiske tahat doshi paye jane par vyakti ko sja di jati hai.


Aap logo ko yah jankari mere dwara di gayi upyogi lagi ho to isko dusro tak jarur pahuchaye taki aur sab logo ko Bhartiya Dand Sanhita ki Dhara 302 ke Bare mein gyan ho jaye.
