Hello Friend's aaj is post mein baat karne ja rha hu mahilao ke adhikar ke bare mein. Yah post un mahilao ke liye jaruri hai, jo kahi par job kar rahi hai. Kyoki is post mein un mahilao se jude kuch adhikaro ke bare mein baat karunga,ki ve mahilaye jo kisi Private sector ya Government sector mein job kar rahi hai yadi ve pragnant hoti hai ,to aise mnein unko kya suvidha di jaati hai unki company ki taraf se.

 Kya hai Prasooti labh ? (What is maternity benefit Act, 1961 ?)
Maternity benefir act, 1961 ke section 3(j) ke anuar, Prasooti pra-suvvidha labh ek aisa labh hai, ji ki niyojak (Employer) ke dwara ek mahila karmchari ko uske prasooti (pregnancy-time) ke time uplabdh karai jaati hai. Yadi us mahila ki delivery hoti hai aur us time vah mahila leave par jaati hai, to aise  mein niyojak dwara us mahila ko 2 week's ka vetan (salary) bhi diya jayega.
Yah salary us mahila ko isi adhiniyam ki dhara 5 ke anusar uske 3 month's pahle  arjit vetan ka ausat vetan hoga.

Jaise hum man lete hai , Yadi prati-din ka ausat lagane par 1 rs se adhk ata hai, to usi dr par 12 week's ka vetan milega. Kisi bhi  dasha mien 1 rs se kam ka majdori nahi milegi. Yadi niyojak sambandhit mahila ko prasav (delivery) se pahle ya prasav ke time koi bhi muft medical suvidha ka prabandh nahi karata hai, to aise mein us niyojak dwara us pregnant mahila ko 1000 rs medical bonus ke roop mein dena hoga.

 Prasooti Pra-suvidha Adhinyam labh ,1961 ke anusar  yah joyna grabh-vati mahilao ke liye banai gayi hai, yah mahila karmchariyo ka adhikar hai, is adhikar pr niyojak dwara kisi bhi prakar se koi rok nahi lagai ja sakti aur in labho mein kisi bhi prakar ki koi bhi kami nahi ki ja sakti hai.

  1. Har ek niyojak pregnant mahila ko prasav (delivery) ke din se pahle 6 week's ki leave  dega, jo har ek pregnant mahila karmchari ka adhikar hai.
  2. IS parkar ki leave aur prarthna patr dene par niyojak 6 week's ka bhi bhugtan (payment) 3 mahine ki ausat vetan  dhyan mein rakh kar  advance mein de sakega.
  3. Prarthna-patra ke sath us mahila ko apna marriage certificate ke sath pregnant report ki ek copy bhi lagani hoti hai, ki vah pregnant hai.
  4. Prasav ke baad 6 week's ki salary legal evidence dene ke 48 ghante ke bhitar hi dena hoga. 
  5. Yadi wah mahila kinhi kaaran se apne niyojak ko notice nahi de pati hai, to iska matlab yah nahi hai ki us mahila prasooti labh nahi milega.
  6. Section 6 ke antargat koi bhi mahila nirdharit form ko bhar kar apne niyojak ko de sakti hai aur adhiniyam ke antargat us mahila ko yah prasooti labh dena hoga.
  7. Yadi kisi bhi mahila ki prasav ke baad mrityu ho jati hai , to vah section 5 ke antargat prasooti labh lene ke bhaar se mukt nahi ho sakegi.
Yadi kisi bhi mahila karmchari ko prasooi labh se vanchit kiya jata, jab vah preganat ho , to aise mien vah mahila 60 dino ke bhitar Competent Officer ke samne appeal kar sakti hai.

Kab prasooti labh jabt kar liya ja sakta hai ? ( When Maternity Benefit forfeited)
 Dhara 6 ke antargat pregnant mahila ko 6 weeks ki leave di jaati hai ,ki wah in 6 week's tak daftar mein kaam karne kel iye nahi a sakti hai, yadi fir koi mahila karmchari in 6 week's ki leave grant hone ke baad bhi sansthan ke kaam karne aati hai, to aise mein us mahila karmchari se yah labh jabt kar kiya jayega jiska pravdhan isi adhiniyam ki dhara 18 mein kiya gya hai.

Yadi niyojak ke dwara is Adhiniyam ka ullanghan kiya jaata hai to dand kya hogi ? (  Penalty If Employer violate's the maternity benefit act, 1961.
 Prasooti Pra-suvidha Adhinyam 1961, ke antargat yah har mahila karmchari ka adhikar hai ki usay is labh se vanchit na kiya jaye aur yah har ek niyojak ka kartavya hai , ki vah har mahil karmchari ko is adhinyam ke antargat prasooti labh dega. Yadi koi bhi niyojak mahil karmchari ko is labh se vanchit rakhta hai , to aise mein wah dandit kiya jayega. 
  1. Jab wah niyojak kisi mahila karmchari ko is prasooti labh se vanchit rakhta hai ya usay yah labh nahi pradan karta hai.
  2. Yadi niyojak pregnant mahila ko 6 hafte ka awkas prasav se pahle aur 6 hafte ka awkas prasav ke baad nahi deta hai. Yah awakas jo 12 hafte ka hota hai prasav aur prasav ke baad ka yah ek aisa awkas hota hai jisme prasav ke baad mahila apna aur apne bacche ki dekh-rekh karti hai.
  3. Yah koi bhi niyojak kisi pregnant mahila karmchari ko 6 hafte ki advance salary nahi deta hai.
  4. Yadi koi niyojak kisi aisi mahila ko jan-boojhkar niyojit karta hai , jo pregnant hai aur 6 hafte ke bhitar bacche ko janm deti hai, ya prasav ke baad 6 hafte ka awkas pura nahi kar payi ho.  yaha ek baat yah clear kar dena chahta hu ki yadi koi mahila khud dhokha deti hai ,to aise mein niyojak uttar dayi nahi hota hai.
  5. Yadi prasav ke baad kisi mahila ki mrityu ho jaati hai aur usko dene wala prasooti pra suvidha labh ko uske dwara namankit  (nominee) ko niyojak dwara nahi deta hai to. 
  6. Yadi niyojak prasav ke 6 hafte baad mahila ko bacche ko doodh pilane ke liye nirdharit  samay jo ki 2 din ka awkas  nahi deta hai.
  7. Yadi mahila karmchari pregnant hai aur vah prasav kaal ke din se 1 mahine pahle  halka kaam karne ke liye prarthna patr ( application) deti hai aur us application ko niyojak dwara aswikar kar diya jata hai.
  8. Yadi niyojak, pregnant mahila ko uski bimari par bhi awkas ki jarurat hone par bhi 6 hafte se atirikt 1 mahine ka awkas nahi deta hai.
  9. Yadi niyojak dhara 12 ka ullanghan kar  kisi mahila karmchari ko job mein se nikal deta hai ya suspend kar deta wah bhi tab jab wah mahila karmchari pregnant hoti hai. 
  10. Yadi niyojak bacche ko doodh pilane ke liye diye jane wale 1 mahina ka vetan kaat leta hai.
  11. Yadi niyojak dwara uchit sarkar dwara niyukt kiye gaye inspector ki karyavahi  ko anuchit tarike se bhang karta hai.
  12. Inspector ke adesho ka palan yadi niyojak ke dwara nahi kiya jata hai, to iske liye niyojak ko uttardayi banaya jata hai.
  13. Notice board mein yadi adhinyam ke sarbhoot niyamo ko nahi dikhaya jata hai ,to niyojak ki hi lapar-vahi mani jati hai.
  14. Register, record ya attendance register ko rakhne par yadi niyojak failed hota hai, to aise mein niyojak hi doshi mana jayega.
Maternity benefit Act, 1961 ke section 21 ke antargat yah bataya gya hai, ki yadi ko bhi niyojak doshi paya jata hai , to aise mein us niyojak ko kya sja di jayegi.

Yadi koi bhi niyojak is prasooti pra-suvidha laabh se kisi bhi mahila ko vanchit karta hai ya isme bataye gaye kisi bhi nyam ka ullanghan karta hai, to aise mein:
  1. Us niyojak ko 3 mahine ki ya to 1 saal ki jail ki sja ho sakti hai.
  2. 2000 rs ya 5000 rs ka jurmana bhi dena ho sakti hai, ya dono prakar ki sja se bhi dandit kiya ja sakta hai.
